1. Acceptance of Terms
By accessing or using RTOCalc (“the Service”), including the calculator, marketplace, and any associated features, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not use the Service.
These Terms apply to all visitors, registered users, and anyone who accesses or uses the Service.
2. Description of Services
RTOCalc provides:
- Rent-to-own calculator: A free tool for modelling lease-option agreements, including payment schedules, down payment accumulation, and mortgage qualification scenarios.
- Marketplace: A platform for listing and browsing rent-to-own properties in Canada and the United States.
- Messaging: A built-in system for communication between marketplace users.
- Educational resources: Articles, podcasts, and guides related to rent-to-own and homeownership.
3. Calculator Disclaimer
RTOCalc is an educational modelling tool — not a source of legal, financial, or tax advice.
- Calculator results are estimates only, based entirely on the values you enter.
- Actual mortgage rates, insurance premiums (CMHC or PMI), property taxes, and other costs may differ from the values used in the calculator.
- The calculator does not guarantee mortgage approval, property appreciation, or any specific financial outcome.
- Results should not be used as the sole basis for entering into a rent-to-own or any other financial agreement.
You should always consult a qualified real estate lawyer, mortgage broker, and/or financial advisor before making any decisions based on calculator results.
4. User Accounts
Registration
To access certain features (marketplace listings, messaging, saved calculations, and favourites), you must create an account. You agree to provide accurate and complete information during registration and to keep your account details up to date.
Account Security
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.
Account Tiers
RTOCalc uses a listing credit system. Each new account receives one complimentary listing credit; additional credits are purchased for a fee. Each credit allows you to create one listing that stays active for 180 days. Agent and Agency tiers offer unlimited listing credits. Your available credits determine how many new listings you may create.
Account Deletion
You may delete your account at any time from your account settings. Deletion is permanent and will remove your profile, listings, messages, saved calculations, and all associated data. See our Privacy Policy for details on data retention.
5. Marketplace & Listings
Listing Accuracy
If you create a listing on the marketplace, you represent and warrant that:
- You have the legal right to list the property (as owner, authorized agent, or authorized representative).
- All information in the listing is accurate, truthful, and not misleading.
- The listing does not violate any applicable laws, regulations, or third-party rights.
No Guarantee of Transactions
RTOCalc is a platform that connects buyers and sellers. We do not participate in, guarantee, or mediate any transactions, negotiations, or agreements between users. Any rent-to-own agreement entered into between users is solely between those parties.
Listing Removal
We reserve the right to remove any listing that violates these Terms, contains inaccurate information, or is otherwise deemed inappropriate, without prior notice.
6. Messaging & Communication
The messaging system is provided for communication related to marketplace listings and rent-to-own inquiries. You agree not to use messaging for spam, harassment, solicitation of unrelated services, or any unlawful purpose.
We do not routinely monitor messages but reserve the right to review message content in response to reported violations or legal requirements.
7. User Content & Images
By uploading content to RTOCalc (including listing descriptions, images, and messages), you:
- Retain ownership of your content.
- Grant RTOCalc a non-exclusive, royalty-free licence to display, distribute, and store the content as necessary to provide the Service (e.g., displaying listing images on the marketplace via our CDN).
- Represent that you own or have the necessary rights to the content and that it does not infringe any third-party intellectual property rights.
When you delete content or your account, we will remove your content from our systems. Cached copies on our CDN may take a short time to be purged.
8. Prohibited Conduct
When using RTOCalc, you agree not to:
- Provide false or misleading information in listings, messages, or account details.
- List properties you do not have the legal right to offer.
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorised access to other users’ accounts or our systems.
- Scrape, crawl, or use automated means to extract data from the Service without permission.
- Upload malicious content, viruses, or harmful code.
- Harass, threaten, or abuse other users through messaging or any other means.
- Circumvent listing limits or account restrictions through multiple accounts or other means.
9. Intellectual Property
The RTOCalc name, logo, website design, calculator algorithms, educational content, and all associated materials are the intellectual property of RTOCalc Inc. and are protected by applicable copyright and trademark laws.
You may not copy, modify, distribute, or create derivative works based on our proprietary materials without prior written permission.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- RTOCalc is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
- We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to financial losses resulting from reliance on calculator results or marketplace interactions.
- We are not responsible for the accuracy of user-submitted listing information or the outcome of any agreements between users.
11. Indemnification
You agree to indemnify and hold harmless RTOCalc Inc., its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or extended inactivity.
Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
